Arnold Laub Sworn In By Gavin Newsome As Commissioner Of The Cities Finance Corporation


On December 21, 2010 Arnold Laub, Esq. was sworn in as commissioner of San Francisco's Finance Corporation. Mr. Laub's duties will include acquiring, constructing, improving, and installing certain real and personal property together with the appurtenances and appurtenant work for the use, benefit, and enjoyment of the public.

San Francisco Tops List As Most Dangerous For Pedestrians


The City of San Francisco has been deemed most dangerous for pedestrians according to a recent survey. More than 800 pedestrians a year and more than 2 people a day on average are hit by a by a vehicle on San Francisco streets.

Supreme Court Case Threatens To End All Class Action Suits

An important case will be reviewed before the Supreme Court today. AT&T Mobility Services v. Conception could have a very serious effect on the ability to file class action suits in the future.

If the Court finds that the Federal Arbitration Act pre-empts State contract law, and allows Class Action Exemptions to contracts, this could be the end of all Class Action Suits in the future.

If the Court were to allow these Class Action Exemptions, this would enable Big Businesses to escape accountability and leave the consumer or employee without recourse since their case is too small for any attorney to take on an individual basis.

ASR Hip Replacement Recall

DePuy, a Johnson & Johnson company, has recalled its ASR Hip Resurfacing System and ASR XL Acetabular System after a 13% failure rate. Johnson & Johnson DePuy has placed 93,000 of the recalled model hip replacements, which means that approximately 12,000 of these units are likely to fail. The failed units will require replacement surgery.

DePuy released a statement saying it “intends to cover reasonable and customary costs of testing and treatment associated with the ASR recall, including revision surgery if it is necessary”. This statement is filled with corporate legal double-speak which promises nothing. If you are contacted by DePuy, you should sign nothing and send them nothing without first consulting an experienced attorney.

Governor Schwarzenegger Signs Expedited Jury Trials Act

On September 30, 2010 Governor Schwarzenegger signed the Expedited Jury Trials Act.  The bill will give Californians the option to have a simplified one day jury trial in civil matters.  Under AB 2284, if both sides agree, civil trials can be heard before an eight member jury, 6 of whom must agree on a verdict that will be binding with limited right of appeal.  Not only does the act provide an opportunity for effecient and economical access to jury trials to Californians, but also helps streamline case management and trial efficiency for California Civil Courts.

We've Got Your Back!



On Saturday, September 18, 2010 employees of the Law Offices of Arnold Laub participated in the "We've Got Your Back" race and fun walk.  The Spinal Research Foundation (SRF) developed the annual "We've Got Your Back" race and fun walk as an educational event to increase spinal health awareness. Participation in this event helps raise funds that directly contribute to life changing research and educational programs.

According to SRF, more than 90% of the population will suffer from severe neck and/or low back pain during their lifetime. Eight percent of these people develop chronic pain, which means that at any given time, 35 million people in the United States are directly affected by disabling pain and many more indirectly.  Techniques to cure, manage and prevent these conditions need to be developed, implemented and proven.

San Bruno Gas Explosion and Fire

     A devastating gas explosion and fire erupted early Thursday evening in San Bruno, California.  Just after 6:00 pm, when many families were arriving home from work in this working class suburb of San Francisco, a huge blast and inferno tore an entire community apart without warning.

     Preliminary reports indicate a ruptured PG&E natural gas line was to blame for the calamity.  There were unverified reports of the smell of natural gas in the neighborhood in the days before the blast.

     As of noon on Friday, there were 4 confirmed fatalities, at least 52 injured, 38 homes completely destroyed, with over a hundred others damaged.

San Francisco Night Clubs: A Venue For Violence


Lee Farley, age 39, was a patron of Jelly’s nightclub on the early morning of July 11, 2010 when he was shot and killed by another patron of the nightclub.  This is the fourth shooting and the second murder at this nightclub in the last two years.

The insufficient supervision and security at this club led to the tragedy that ended in the death of Mr. Farley.  Mr. Farley, a father of 9, was accosted inside the club by another man.  The altercation then spilled outside the club and ultimately led to the suspect shooting Mr. Farley in the chest, killing him.

This club is just one example of the many problematic clubs in this City.  On August 9, 2010 two women were shot early in the morning outside the SOMA nightclub 1015 Folsom.  On Sunday, August 15 a German tourist was shot and killed while walking around Union Square with her husband when a private party that rented out a club erupted into a gun battle between two rival groups. 

Another San Francisco club, Suede, was closed down in February of this year after a shooting incident that left one dead and four people injured.

Although it appears that Jelly’s will be shut down permanently since the Port of San Francisco has rescinded their lease, it is important that we stop these problems before more innocent people are killed.
